Aggravated DWI charge dismissed.

July, 2008.  After blood test results indicated an alcohol concentration of over .19, more than 2 times the legal limit, Attorney Welsh’s client was arrested and charged with Aggravated DWI.  Because it was an Aggravated DWI, the client was facing one year mandatory license suspension in addition to the 6 month administrative license loss for refusing a breath test.  The client had also allegedly made statements admitting to being intoxicated. 

Result: Attorney Welsh persuaded the prosecutor to drop the Aggravated DWI charge and to forego prosecution of the six month administrative license loss.  As a result, the client avoided the mandatory jail sentence and the mandatory minimum 1 year license suspension.  Additionally, if convicted of Aggravated DWI, the client would have had to install an ignition interlock device even after having her license reinstated.
